User Question: I have pending asylum. My final hearing is in May. I want to fly from Florida to Chicago. I have an Illinois state ID and EAD. I entered the USA in 2022 illegally. Am I safe to take a domestic flight? I’m really scared but I have to go back to Chicago because that’s where I work, and I am traveling with my boss. I need your advice.

Expert Answer: As a pending asylum applicant with an EAD and state ID, you should generally be able to travel domestically within the U.S. However, airports are federal jurisdiction, and TSA agents may refer travelers to immigration enforcement if there are concerns about their status. Since you entered the U.S. unlawfully, there is a small risk that CBP officers at the airport could question you.

To reduce risks, ensure you carry all valid identification, including your EAD and state ID. If approached by immigration officers, you have the right to remain silent and request legal counsel.
