User Question: I entered the U.S. with my wife and two children on December 3, 2024. Border Patrol gave us separate case files, and we have a hearing date in New York court on July 28, 2025. My lawyer says my case has not been submitted to the Department of Homeland Security (DHS), and it does not show online. What should I do?

Expert Answer: If your case is not yet reflected in the system, you should first verify your court case status by checking the EOIR hotline at 1-800-898-7180 or using the EOIR online case status tool. If your case is not found, your lawyer may need to follow up with DHS or the immigration court to confirm your Notice to Appear (NTA) was properly filed. You must ensure your asylum application (Form I-589) is submitted within one year of your entry to the U.S. to remain eligible. Consult your attorney to take the necessary steps to file and track your case properly.
